WE ARE NOT A REGISTERED INVESTMENT ADVISER, BROKER-DEALER, BANK, INSURANCE PRODUCER, TAX PREPARER, ACCOUNTANT, OR LAW FIRM, AND WE DO NOT PROVIDE INVESTMENT, TAX, ACCOUNTING, LEGAL, INSURANCE, OR FINANCIAL ADVICE OF ANY KIND. 1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you and Financho (“Financho,” “we,” “us,” or “our”). By accessing or using Financho, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the service. You must be at least 18 years old and legally able to enter into a contract to use Financho. The service is intended for residents of the United States; we make no representation that it is appropriate or available elsewhere.

2. Description of Service

Financho is a self-directed financial-education and planning tool. It lets you model your financial future, run retirement and tax projections, compare scenarios, track holdings, and receive automated, informational guidance through interactive explorers, a Digital Coach, and an AI assistant. The accuracy and usefulness of every output depend entirely on the data and assumptions you provide. Financho does not execute transactions, hold or move money, manage accounts, or take custody of any assets.

3. Not Financial, Investment, Tax, or Legal Advice

Financho provides general financial education and self-directed planning tools only. We are not your fiduciary, adviser, or representative. The service does not constitute, and must not be construed as, investment advice, a recommendation to buy, sell, or hold any security or asset, tax or accounting advice, legal advice, insurance advice, or an offer or solicitation of any product. Tax, retirement, Social Security, healthcare, and estate rules are complex, vary by individual circumstances, and change frequently. You are solely responsible for your decisions and should obtain advice from a licensed financial adviser, CPA, tax professional, insurance agent, and/or attorney appropriate to your situation before acting.

4. Projections, Simulations & Forward-Looking Information

Projections, Monte Carlo simulations, success probabilities, wellness scores, Roth-conversion and withdrawal-strategy comparisons, Social Security estimates, and similar outputs are hypothetical, are for illustration only, and rely on assumptions and simplified models that will not match reality. Monte Carlo results describe a range of modeled outcomes for the assumptions entered — they are not predictions and do not account for every real-world factor. Investment returns are not guaranteed and may be negative; past performance is not indicative of future results. Actual outcomes will differ, potentially materially, from any figure shown. No projection should be interpreted as a promise, guarantee, or assurance of any particular result.

5. AI Features

Financho includes AI-powered features, including the text and voice AI assistant and AI-generated content such as the Emergency Roadmap. These features are powered by third-party large language models and produce automated output that may be inaccurate, incomplete, out of date, or wrong even when stated confidently (“hallucinations”). AI output is not advice, is not reviewed by a human professional, and must be independently verified before you rely on it. To provide these features, the data and questions you submit are processed by third-party AI providers as described in our Privacy Policy. Do not submit information you are not comfortable processing in this way.

6. Tax Figures & Third-Party Data

Tax constants used by the engine (such as federal and state brackets, standard deductions, IRMAA tiers, contribution limits, and Medicare premiums) are compiled from public sources and are maintained in part by automated and AI-assisted processes. They may be inaccurate, incomplete, or out of date, may not reflect the most recent law or your specific situation, and are not a substitute for official IRS, SSA, CMS, or state guidance. Market and security data shown in the portfolio and elsewhere are provided by third-party vendors, may be delayed or inaccurate, and are provided “as is” for informational purposes only — they are not a recommendation to buy, sell, or hold any security. We do not warrant the accuracy, completeness, or timeliness of any data and are not liable for reliance on it.

7. Emergency Access (“Break Glass”)

Emergency Access is an optional convenience feature that lets you generate a code which, if presented by another person and after a waiting period during which you may cancel the request, can grant that person access to your Financho household data and Emergency Roadmap. You understand and agree that:

  • It is not a will, trust, beneficiary designation, power of attorney, or any other legal or estate-planning instrument, and it does not transfer, assign, or grant any legal right to any money, account, or asset. It only controls access to data inside Financho.
  • Financho does not verify the identity, authority, relationship, or intentions of anyone who presents a code, and does not verify any death, incapacity, or emergency.
  • You are solely responsible for deciding whether to enable the feature, for the contents of your Emergency Roadmap, and for keeping your code confidential. Anyone who obtains your code may be able to request access.
  • The AI-generated Emergency Roadmap is informational only and is not legal, financial, tax, or estate advice.
  • To the fullest extent permitted by law, Financho is not liable for any access, disclosure, loss, or harm resulting from your use of, or another person’s use of, this feature, including misuse of a shared, lost, or stolen code.

8. Subscriptions, Free Trial, Billing & Auto-Renewal

Certain features require a paid subscription. Payments are processed by our third-party payment provider, Whop; charges appear as “WHOP” on your statement and are also subject to Whop’s terms. By starting a subscription you authorize recurring charges as described below.

  • Free trial. Paid plans may include a free trial (currently 30 days). Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged the then-current price.
  • Auto-renewal. Subscriptions are billed in advance on a recurring basis (currently $99.99 per year) and automatically renew at the end of each billing period at the then-current price until you cancel. Renewal is automatic so your access is not interrupted.
  • Cancellation. You may cancel at any time from Settings → Subscription or through your Whop account. Cancellation stops future renewals; it takes effect at the end of the current billing period, and you retain access until then.
  • Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused time. Cancelling before the end of a free trial means you are not charged.
  • Price changes. We may change subscription prices and features. We will give reasonable advance notice of any price increase, which will apply to your next renewal; if you do not agree, you may cancel before it takes effect.

9. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials and any Emergency Access code, and for all activity under your account.
  • The accuracy and completeness of the data and assumptions you input.
  • Ensuring your use of the service complies with applicable laws and regulations.
  • Making your own financial decisions. Financho is a tool to aid your analysis, not a replacement for professional advice.
  • Not misusing the service — including no unauthorized access, scraping, reverse engineering, reselling, or use that infringes rights or violates law.

10. Intellectual Property

The software, including its design, algorithms, and content, is the property of Financho and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the service for your personal, non-commercial planning. You retain ownership of the data you enter; you grant us a license to process it as needed to operate and improve the service, consistent with the Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CALCULATION, DATA, OR OUTPUT IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FINANCHO AND ITS OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, SAVINGS, DATA, OR GOODWILL, OR FOR ANY FINANCIAL, TAX, OR INVESTMENT LOSSES OR DECISIONS MADE BASED ON THE SERVICE OR ITS OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PROJECTIONS ARE INHERENTLY UNCERTAIN AND MARKET AND LEGAL CONDITIONS CAN CHANGE RAPIDLY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Financho and its owners, operators, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your data, your use of Emergency Access, or your violation of these Terms or applicable law.

14. Termination

We reserve the right to suspend or terminate your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business. You may stop using the service and delete your account at any time. Sections that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.

15. Governing Law; Binding Arbitration; Class-Action Waiver

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Except for claims that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by final and binding arbitration administered on an individual basis, seated in South Carolina, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Class-action waiver. You and Financho agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding.

Right to opt out. You may opt out of this arbitration and class-waiver agreement by emailing us at the address below within 30 days of first accepting these Terms; if you opt out, disputes will be resolved in the state or federal courts located in South Carolina, to whose exclusive jurisdiction you consent.

16. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms here and update the “last updated” date, and where appropriate provide additional notice. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
